Refund and Cancellation Policy - Trending & Advertisements

1. Scope of this Policy
1.1 This Refund and Cancellation Policy (“Policy”) applies to all paid “Trending” & “Advertisement” services (“Trending Products”, “Trending Services”, “BIMPAI Ads”) purchased on or through BIMPAI, whether via our website, mobile applications or any other BIMPAI/IEPSSOLS-branded digital interface (collectively, the “Platform”).
1.2 By purchasing a Trending Ad, you (“Advertiser”, “you”, “your”) confirm that you have read, understood, and agreed to be bound by this Policy, together with our Terms and Conditions, User Agreement, Privacy Policy, Cookie Policy and Disclaimer, as updated from time to time.
2. Nature of the Service
2.1 BIMPAI is a digital networking and listing platform that provides ad space and visibility tools to promote products and services through Trending Ads. We facilitate visibility and discovery; we do not sell or supply the products or services being advertised.
2.2 We do not guarantee any specific business outcome, including but not limited to leads, enquiries, sales, conversions, reach, impressions, or engagement metrics from any Trending Ad campaign.
3. General Non-Refund Policy (Subject to Law)
3.1 All fees, charges and amounts paid for Trending Ads are generally non-refundable once the payment is successfully processed and the advertising order is confirmed on the Platform.
3.2 You will not be entitled to any refund, in whole or in part, on any of the following grounds, including but not limited to:
- Change of mind, internal business decision, or budget constraints.
- Dissatisfaction with campaign performance, reach, impressions, clicks, engagement or perceived return on investment.
- Zero or low responses, enquiries, or sales from users or customers.
- Incorrect category, targeting, duration, creatives or content provided or selected by you.
- Suspension, restriction or termination of your account or campaign due to violation of our Terms, policies, or applicable law.
3.3 To the maximum extent permitted by applicable Indian law, IEPSSOLS PVT. LTD. and BIMPAI shall not be liable to refund any amounts paid for Trending Ads once such Services are booked, ad inventory is reserved, or the campaign is initiated.
3.4 Exception recognition (law & networks): Notwithstanding the above general non-refund stance, we recognise that in certain limited circumstances, refunds may be required under:
- Applicable Indian law and mandatory consumer protection norms.
- Card-network rules, bank/issuer directions, or Razorpay’s dispute/chargeback process. In such cases, we will abide by the final directions given by the relevant authority or payment system.
4. Razorpay-Linked Refund Processing
4.1 We use Razorpay (and/or any other authorised payment gateway) to process payments for Trending Ads. Any refund, if and when approved or required in an exceptional case, will normally be processed only through the same payment gateway and only back to the original payment method, as per gateway and banking rules.
4.2 We reserve the sole discretion to decide whether a refund is appropriate in a given case, except where a refund is mandated by law, card-network rules, bank/issuer direction or Razorpay’s chargeback/dispute outcome.
4.3 Any refund processed under such exceptional circumstances shall be treated as a one-time exception to this Policy and shall not create any right or expectation of similar refunds in future cases.
5. Limited Platform-Level Non-Monetary Remedies
5.1 In the event of a verified, platform-level technical failure solely attributable to BIMPAI (for example, a complete failure of the campaign to run due to a system outage and not due to your act/omission), we may, at our sole discretion, offer one or more of the following non-monetary remedies in lieu of a monetary refund.
- Extension of the campaign duration; or
- Allocation of equivalent or comparable ad inventory on another date; or
- Credit of equivalent promotional value to your BIMPAI account for future use.
5.2 Our logs, reports and system records shall be final and binding for determining whether a technical failure occurred and the extent of any such failure.
6. Cancellation of Trending Ads
6.1 Once a Trending Ad order is placed and payment is successfully processed, the campaign is considered confirmed and ad inventory/time slots may be immediately reserved.
6.2 You are not entitled to cancel a confirmed Trending Ad campaign and seek a refund, even if the campaign is yet to start running, as resources and inventory may already have been allocated.
6.3 Where technically feasible, we may, at our discretion, allow you to modify certain campaign parameters (such as creatives or dates). Any such modification:
- Is not guaranteed; and
- Will not entitle you to any refund or reduction in the fees already paid.
7. No Responsibility for Advertised Products/Services
7.1 Any product or service promoted using a Trending Ad is offered solely by the respective advertiser/business. All subsequent transactions, fulfilment, returns, replacements and customer support relating to such products/services are strictly between the advertiser and its customers.
7.2 BIMPAI and IEPSSOLS PVT. LTD. are not parties to such downstream transactions and will not be responsible for product quality, authenticity, delivery, warranties, or after-sales support, or for any financial loss, fraud, misrepresentation, or dispute arising therefrom.
7.3 Any refund or compensation that may be legally payable to end-customers for defective, deficient, or misrepresented products/services remains the sole responsibility of the advertiser/business, not of BIMPAI or IEPSSOLS.
8. Policy Breach, Misuse and Removal of Ads
8.1 We reserve the right, but not the obligation, to review, suspend, reject or remove any Trending Ad that:
- Violates applicable law, regulations, or advertising norms.
- Is misleading, fraudulent, defamatory, obscene, offensive or otherwise inappropriate.
- Infringes intellectual property or other rights of any third party.
- Violates our Terms and Conditions, User Agreement, Privacy Policy, Cookie Policy or any other policy notified by BIMPAI.
8.2 Where an ad or account is suspended or removed for policy breach or legal/regulatory reasons, you will not be entitled to any refund, and we may treat the entire amount paid for that campaign as forfeited, to the extent permitted by law.
9. Disputes, Chargebacks and Cooperation with Razorpay
9.1 If you or your customer disputes a transaction, we encourage the customer to first contact us using the details in Section 11 so that we may attempt to resolve the issue amicably.
9.2 In case of disputes or chargebacks raised through banks, card networks or Razorpay, we will cooperate by providing relevant evidence (such as logs, reports and campaign details) and will follow the applicable dispute resolution processes as per bank and Razorpay rules.
9.3 If a dispute/chargeback is finally resolved in favour of the customer and a refund is processed by the issuing bank, card network or Razorpay, such refund shall be treated as an exception to this Policy and shall not create any ongoing right to refunds in any other case.
10. Statutory Rights and Unfair Terms
10.1 Nothing in this Policy is intended to exclude, limit or override any non-excludable statutory rights available to consumers under applicable Indian laws, including but not limited to the Consumer Protection Act, 2019 and any rules made thereunder.
10.2 If any provision of this Policy is found by a competent authority to be invalid, unfair, unconscionable or contrary to law, that provision shall be read down, modified or severed to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
11. Governing Law and Jurisdiction
11.1 This Policy shall be read together with our Terms and Conditions and User Agreement and shall be governed by and construed in accordance with the laws of India.
11.2 Subject to any mandatory provisions of law, any dispute arising out of or in connection with this Policy or any Trending Ad shall be subject to the exclusive jurisdiction of the competent courts at Kolkata, West Bengal, India.
